In a move that really shouldn’t surprise me in the slightest yet still does, the 1% landlords/masters of the universe have announced that they are seeking to change the law so privately owned public parks, like, for instance, Zuccotti Park, are no longer required to saty open 24 hours a day.
Shockingly, this would have the immediate effect of terminating any and all Occupy camps. In a jaw-dropping statement that redefines the word disingenuous, Steven Spinola, president of the Real Estate Board of New York had this to say:
“We’re going to be clearly recommending to the city that there need to be some changes… If you can say that the plazas are closed between 1 and 5 a.m., I’m not sure who that’s harming.”
The fact that parks like Zuccotti are open 24 hours a day is an oversight in the original intent of the law which was a trade-off between the city and realtors. We got parks and they got the ability to build higher than the zoning laws allowed. No one thought that it would become a battleground for the First Amendment.
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.
Of course, one way around this is to make it illegal to actually gather anyplace to protest. Or to use bullhorns to make yourself heard. Or to protest within earshot of the very thing you wish to protest. Or to walk on public sidewalks while protesting. You get the idea. The 1% are abusing the law to take away our Constitutional right to peaceably assemble and using the police to enforce their will.
Somehow, I don’t think that’s what the Framers had in mind.

Please clarify, are you saying that privately owned parks are REQUIRED to stay open or ALLOWED to stay open? Will the new law REQUIRE these parks to close at night or ALLOW them to close at night?
They are required to stay open as part of the deal that allows the property owners to exceed city zoning laws. They want to change it s that they can close at night. Whether it is a legally required closing or a voluntary one I can’t say but the effect would be the same.

The first order of business is to eliminate the corruption stream by voting all career incumbents out of office and limiting terms of office to one year. It is more import to spend money on expert witness than to hire puppets that have no answers worth listening to…
The objective is to spell out the problems (the root causes) provide the solutions (the answers that will make the changes) that will provide Equality, Equity and Parity as the Goal, Objective and Plan…

The biggest problem the citizen faces is eliminating the power these people in government have in the decision making process. These people should have no authority to make decisions. They are suppose to be the citizen’s servants not their masters… These people have made bad decisions ad infinitum..

Sounds like the Tea Party to me… I just hope it doesn’t apply to OWS as well.
But the few are definitely going to try any scheme to avoid their responsibilities, and it is up to us to force the issue. There WILL be a reckoning, and it will probably come pretty soon now, the richies are fed up with all of our demands for rationality – (hey which is more important, today’s quarterly report or next year’s oxygen?), and we are fed up with the hypocrisy and depraved indifference of the 1%.
It would be lovely, and preferable, if this could be resolved without violence. But don’t bet on it, they have spent YEARS setting up this attempt to destabilize and co-opt the government, and they are damn close to finishing the job. The only way we will be free of them is to be free of them.
So get your supplies, your tactical plans and your ammo. Be ready for what is quite likely the final American election…
Wow! You are the first person to say it out right. There will be civil war in this country. Being Americans does not exempt us from the ways of the world. Many people think that if they just ignore it, it will go away. Well, we are not going away, and I don’t think the 1% is going to step down and leave the country willingly, so… That gives the people no other option. I have been collecting ammo for years. 2012 isn’t the end of the world. It is the end of the US government’s reign of terror.
I was just talking about the Dunning-Kruger effect a few days ago in this context…funny to see it mentioned here. It does indeed sound like the Tea Party and its sympathizers. As for OWS, I expect that group has more than its share of highly competent folks–the spoken and written expressions I’ve heard and seen from the occupation are informed and thoughtful; the issues are complex, not reducible to sound bites.

Thanks, new information … had to look up Dunning-Kruger … hadn’t heard of that one. I completely agree.
I, on the other hand, have heard of Dunning-Kruger (it almost certainly holds water with a lot of posters/posters’ comments—but that goes for 99.99989% of the rest of the interwebz, too) but never of ‘The Peter Principle’. The latter (although its Wiki entry claims it to be only in ‘humor’) is seriously flawed in its reasoning, not taking into account probably-infinite types of exceptions.
“The Peter Principle” was an educated joke.
