Police Defy Orders To Arrest Occupy Albany Protesters

In Albany, NY, police are refusing to arrest Occupy Albany protesters, despite orders from Governor Cuomo and Mayor Jennings.

In a tense battle of wills, state troopers and Albany police held off making arrests of dozens of protesters near the Capitol over the weekend even as Albany’s mayor, under pressure from Gov. Andrew Cuomo‘s administration, had urged his police chief to enforce a city curfew.

The situation intensified late Friday evening when Jennings, who has cultivated a strong relationship with Cuomo, directed his department to arrest protesters who refused to leave the city-owned portion of a large park that’s across Washington Avenue from the Capitol and City Hall.

At the Capitol, in anticipation of possibly dozens of arrests, a State Police civil disturbance unit was quietly activated, according to officials briefed on the matter but not authorized to comment publicly. But as the curfew neared, the group of protesters estimated at several hundred moved across an invisible line in the park from state land onto city property.

“We were ready to make arrests if needed, but these people complied with our orders,” a State Police official said. However, he added that State Police supported the defiant posture of Albany police leaders to hold off making arrests for the low-level offense of trespassing, in part because of concern it could incite a riot or draw thousands of protesters in a backlash that could endanger police and the public.

“We don’t have those resources, and these people were not causing trouble,” the official said. “The bottom line is the police know policing, not the governor and not the mayor.”

The city also expressed concern with public relations and the fact that there are elderly and children protesting.

I’m actually surprised more of this isn’t happening. Police officers are part of the 99%. Their jobs are being cut. Because of manpower shortages, they are put into more danger. Their unions are being busted. Their pensions are being threatened. More power to the police in Albany!

  • More power the Albany PD??? WTH ? Listen, this former leo agrees they did the right thing but it goes deeper than that. These guys were looking out for themselves. Okay perhaps they were concerned about not hurting protestors as well. The bottom line is that the Police confronted with danger to themselves back down. You never have seen the police back down from a person who claims his sovereignty. The police are trained in a lot of things but they are not trained or updated to the laws. They put their proverbial heads into the law (STATUES, CODES, etc) but they never look at the “CASE LAW” from the courts, appeals, Supreme courts where they have “UPHELD” the constitution and for instance they have said that ” a person has the right to travel” freely , unencumbered..in their personal/private vehicles.. which means they do not need a license, registration, inspection sticker etc.. to use “public” highways. Instead they arrest the sovereign and waste the courts time and occasionally they get a guy or gal who is not knowledgable about the right to travel and the courts walk all over them. Most people “go with the flow” and if cops were truely protecting and upholding the Constituiton and all the laws we would truely have a better country to live in and they would be respected as “peace officers” and not thugs with a badge.
