US Senate To Vote On Bill That Will Allow The Military To Arrest Americans On American Soil And Hold Them Indefinitely

Since Occupy Wall Street began, American police officers have arrested thousands of people for exercising their constitutionally protected right to protest. On Monday or Tuesday, the US Senate will vote on a bill that would give the President the ability to order the military to arrest and imprison American citizens anywhere in the world for an indefinite period of time.

A provision of S. 1867, or the National Defense Authorization Act bill, written by Senators John McCain and Carl Levin, declares American soil a battlefield and allows the President and all future Chief Executives to order the military to arrest and detain American citizens, innocent or not, without charge or trial. In other words, if this bill passes and the President signs it, OWS protesters or any American could end up arrested and indefinitely locked up by the military without the guaranteed right to due process or a speedy trial.

This bill was written in secret and approved by committee without a single hearing. Senate Republicans support the bill and enough Democrats support it to give it a great chance of passing. This provision does have opponents. President Obama has threatened to veto the bill and even Ron Paul is concerned enough to bring it up during one of the GOP debates. An amendment called the Udall Amendment has been offered by Democratic Senator Mark Udall that would delete the dangerous provision.

If you are an American citizen, protect your constitutional rights. Call your senator and tell them to approve of the Udall Amendment. No American citizen should be arrested by the military and held indefinitely without charge or trial. It’s not conducive to American values and would give the military and the government more power over the American citizenry. The last time Americans had to deal with an overreaching military was during the Revolutionary era. Because of that, the Founders included the 3rd Amendment to ban the quartering of troops during times of war and peace. Once again, Americans are under threat of dealing with a military that has more power than it should have. And it could cost us most of the freedoms we tend to take for granted.

America is NOT a battlefield. America is a free country and American citizens should not ever be arrested by the military and certainly not without being charged or getting a trial. This provision would cast aside the Constitution and put the liberties of American citizens here at home and around the world at serious risk. Please call your senator or visit this link, because this is a risk Americans cannot afford to take.

    Wars are waged by older men
    In battle rooms in countries apart.
    Who call for greater firepower
    And troops for the combat chart.

    While out among the shattered flesh

  • Everybody’s concerns are valid here. I’m a member of the US armed forces and this act concerns me greatly. All that is required is the mere accusation of terrorists activities (having more firearms that the average person, a sizable amount of ammo, going to the gun range, being a combat veteran with knowledge of tactical warfighting) and the US military can seize your property and detain you indefinitely without the protection of constitutional rights. It’s not just the bill that is scary, but people’s lack of interest. Apathy within our society is what is going to make it easier to be slaves to the power. I will tell you all, I love this country and it’s founding ideals of Liberty and Inalienable Rights. I would rather die a free man than to live as a slave. If and when I get the order to disarm and imprison my fellow citizens, that is the day that I and many of my military counterparts will begin the rebellion. We have sworn to protect and defend the Constitution of the U.S. and it’s citizens against enemies foreign and domestic. I Cannot and Will not follow such an order.

  • It’s about that time to retire from the military to relax and enjoy all the things you’ve fought for over the pass years. Yet, unlike jobs in the civilian world, you’re still relatively young to be retired already. Some veterans lay back during their retired years, but most veterans can’t get used to sitting at home all day.

  • The Senate Health Bill has been grabbing headlines for months as members of the Senate continue to debate spending, bill allotments, and the merits of improved or universal healthcare coverage. The latest iteration of this bill in late November and included a price tag of $849 billion, according to the Congressional Budget Office. $200 billion alone would be set aside to help cover doctors’ fees so that they would not suffer from a drastic cut back to reimbursement rates.

    We Indigenous Peoples of the Northern hemisphere have been living under martial law in one form or another for quite some time now…

    The Navajo, Apache & Minnesota Dakota are all too familiar with this practice… This time of year we remember the Dakota War of 1862 as well as the Wounded Knee Massacre of 1890. The Dakota war culminated in the largest mass assassination in US history when Abe Lincoln ordered the hanging of 38 Dakotas (the youngest was 13) @ Mankato, MN on December 26. (They wanted to give the soldiers the Christmas holiday off while the prisoners nearly froze to death while awaiting the gallows) There is a memorial run honoring the assassinated and their descendants from Ft. Snelling in St. Paul to Mankato Christmas night. They begin @ midnight on the 26th and arrive @ the site where the gallows stood (now the Mankato public library) @ 10am on the 26th (the time of the hanging). There is much written on this & is readily available on the internet.

    There is also a memorial ride for the fallen and the survivors of the Wounded Knee Massacre that begins on the Standing Rock reservation on December 15 and follows the trail Big Foot’s people followed to Wounded Knee arriving on December 29 ( the anniversary of the Massacre.)

    We are preparing for that now. Where I live (Bridger, SD) is the last place Big Foot camped before Wounded Knee & the first place the survivors made it back to afterward. During the ride there is a “day of rest” in Bridger. The riders arrive on December 21, rest, then pray, mount up & head out @ dawn on December 23. Every year since we moved back to Bridger, my husband and I open our homes to the riders. We feed, shelter and entertain them while they are here. before they leave we give them a hand held breakfast (cinnamon frybread/ breakfast burrito/ english muffin sandwich, etc.. something) & fill their thermoses with coffee for the next leg of the ride. After leaving Bridger they will spend 6 days braving the elements out in the open until they arrive in Wounded Knee.

    My husband is a descendant of Big Foot’s grand daughter who survived the massacre. His Lakota name, Waniyetuopi, translates as “wounded (or “shot”) in the winter” and is a direct reference to one of the victims… the infant grandson of Big Foot who was shot and killed as his mother fled with him in her arms…Big Foot’s daughter was also killed. The baby was so young he had not yet been named so the only reference his older sister had was “Waniyetuopi” which is what she named her first son in honor of the brother she lost. This name was passed on to my husband, the youngest of 6 brothers so that the baby will not be forgotten.

    It is easy to make the comparisons to what has historically happened to Indigenous Nations and what is happening now to the rest of the population now. It’s kind of like a “what goes around comes around” type situation. For the past 150+ years we have been trying to get support for honoring our rights (especially sovereignty) as Indigenous Nations we have been categorically ignored and violated in one way or another by the majority of US citizens. Now the same thing is happening to US citizens that has happened to us and US citizens are scratching their heads wondering why the banks, military, law enforcement, judiciary, legislative and executive branches of government from local to federal are categorically ignoring their own citizens. US citizens have already let them get away with doing it to us (as well as “imported” minority groups… slavery, Japanese internment during WW2, etc.) since before the US was officially a country. What makes anyone think it couldn’t happen to them? So much for white privilege…. or any other for that matter…except of course for those “in power.” (the 1%)

    With all this history it is easy to continue to be outraged at current legislation but the overall consensus here is that the US has been doing this kind of thing to us for more than 150 years (longer for other tribes).. We are not surprised. If your government would have so little respect for us and our treaties what makes anyone think they would be different to anyone else… including their own citizens? We have been fighting these things alone for 150+ years… WELCOME TO THE INDIAN WARS.

    In his book Where Have All the Leaders Gone? Lee Iaccoca blasts the Japanese for their hardline stance against more liberal trade agreements with the US. Why do you think countries like China and Japan do NOT want open trade or other agreements with the US that would favor US trade and labor? They have seen what similar agreements have done to us. The Chinese and Japanese people are also Indigenous Nations. Lee Iaccoca is one of the 1%.. all power and privilege… no respect… or common sense. His best bet would be to aggressively support the treaty rights of US Indigenous Nations. If the US wants a better world market they should start here.

  • BE CAREFUL U.S. Citizens! Those type of actions are very dangerous! I´m not trying to be sensationalist, but just look at my country (México), taking the militaries to the streets has not brought anything better, it´s just the opposite, it gets everything worst, as taking them to the streets brings some social (and very violent) reactions (such as the militarization of goverment opposing groups, for example criminal groups). And no, I´m not telling that the militaries are bad, but they are trained to obey, not to investigate. I repeat: BE VERY CAREFUL!!

  • I have a greater question that needs to be answered: Does John McCain have dementia? Did the Viet Cong get him to turn? Has he been a mole all these years and was signaled to become activated? You might as well tell me that Obama has confessed he has never been a U.S. citizen and is resigning than to believe such a bill could ever be contrived by an American War hero……Sorry…..don’t know what others are smokin’ these days.

  • What ever the argument, we should take care when discussing providing additional authority and power to our government by our government, one which in my opinion not only has too much power at present but also does not wield it’s power as correctly as it should. All of this information is confusing to myself as I’m sure it is to others but understanding it is not necessary, the bottom line for myself is that ANY person on American soil should be treated in a manner consistent with the beliefs of our country as stated by our constitution else where are our principles and why are we at war in other countries incurring the loss of American lives, gabillions of tax payer dollars? I don’t understand all of this but it seems to me I can smell it and recognize the stench without doubt.

  • Any politician who signs off on this should stripped from office and blacklisted. It is time to wake up people and get our government in check. Lets see if we can go 5 years without invading random countries, pay down the debt and start reinvesting into this county and cut out the fascist police state nonsense like this otherwise lets just trash the constitution already since that’s where things are going.

  • The laws in this land are a farce. They protect the criminals and punish the innocent. I will direct you all to the second amendement of the US Constitution. Above all laws, the rule of force is your only defense against all enemies, both foreign and domestic. The slaves of this nation are awakening in a land that they no longer recognize, realizing they have been carrying chains of oppression their whole lives. Picking over the exemptions in one bill or another is ultimately a waste of time as ALL of our laws are interpreted as the sitting judicial body sees fit. Laws are NOT black and white, they ARE ignored when it benefits the criminal government and their associates and twisted to condemn political opponents and dissenters.

  • Not gonna happen. The original bill proposal wording was a mistake. To vague! So it is being changed.

    It couldn’t ever passed the courts anyway. No need for your outrage. No need to get all “up in arms” about it. Like someone in Congress pointed out. “Hey, the current wording of this bill violates the constitution…. we better change that or else the bill will not pass. Or if it does, the Supreme Court will just toss it out.”

    Due Process is guaranteed by the Bill of Rights for all American citizens. Although it would be the right thing to do for non-citizens too… there is no such provision in our constitution.

    That is why we have checks and balances. To ensure mistakes like these don’t happen. And it works (on occasion). :)

    • I’m amazed that people are so cavalier about the very idea of this bill. It’s as if it isn’t all that bad that our military would be able to grab up people anywhere in the world as long as people within the US are exempt.

      It’s sickening. The US. Where people are so tough and brave that they will allow a fascist military world police to boot stomp over the rights of humanity as long as we’re cozy and safe from the scary terrorists.

      Grow a backbone, people. This kind of fascist insanity would have been totally laughed at 20 years ago. It would have been thought absurd that such legislation would even be seriously considered.

    • I’ll be sure to come to visit you when you’re languishing in indefinite detention to let you know that “the Supreme Court should be tossing this out any day now!” It should only take a few years of your life, and I’m sure you’ll make the most of them.

    • The right to keep and bear arms is in the bill of rights also. Any idea how much it is under attack?

    • Where were you Joe the last few months when police in jurisdictions all over the country have been violating the constitutionally “guaranteed” right to freely assemble. You seem to be in denial about the changing landscape. Checks and balances today in America have more in common with the tooth fairy and Santa Claus. The judicial system has been taken over all the way back to the granting of individual person-hood status to corporations. The vast majority of court precedents have now been set by one corporation versus another and the money in the system has bought and paid for the legislative and executive branches. This is why the powers that be are free to persecute a non-violent movement exercising constitutionally guaranteed freedoms with police powers from the totalitarian playbook. I would love to wake up and discover it was all just a bad dream!

  • As a Canadian or any visitor visiting your country if you are stop for example speeding and the police see you are alien you may

    1 Be arrested and detained until it is proven you are not a treath to the country.
    2-Strip searche
    3-Kept in jail until proven safe. If it is week-end to bad… for you
    4- It has happened to Canadians. Gender or age does not matter.

  • May I point out that the military are not nromally trained to handel the situation of a civilian arrest. Especially when the person is protesting hay I am an American and I have rights. The soldgers will be in unfamilure seroundings and stressed out. They may not agree with the exact situation or how they are ordered to deal with it. Becuse the military are normally trained to win wars. Yes they do that very well and full credit to them. However they are not trained to handel civilians and arrest them, especially of their own country. In the police force they are tought the law and how to do their jobs while working with in it, becuse they must help present a case to a court afterwards. Here the military who are trained to go into combat and defend the team, and win the war. Not defuse the situation through negociations or defuse a situation bring it back to a resonable situation. There is more to being a cop then beating people up, using a gun, and arresting people. Ask any cop arresting or shooting is the last thing they want to do. Under this bill the military will not have to front up to a court to exsplain the arrest procedure and how they pretected the persons rights.

    • Oh please. Go watch the 20 – 30 videos of unprovoked police brutality from the last 3 months. Then go watch the collections of videos on police brutality and gangsterism that have been available for years. When most of these schmucks are given power and told that “they are the authority”, they go off on this authoritarian ego-maniacal kick.

      The police have been militarized in this country for decades. They don’t even need this draconian bill for the actual military to do it. The cops have the LRAD, tasers, UAVs, riot armor that is basically military grade, automatic weapons, helicopters, I mean we could go on all day.

      The police have been militarized so that they didn’t have to pass draconian laws suspending Posse Comitatus. Just have the soldier cops do it.

  • I agree with most of this post, but the Revolutionary era was not the last time Americans had to deal with an overreaching military. One very large example is during WWII when innocent Japanese-Americans were unlawfully detained in internment camps.

    • What about the countless innocent German-Americans that were incarcerated in the internment camps? Especially since the last internment camp set free was of German-Americans and they were released in 1953. The Feds need to be stopped, the worst decision made in our country’s history was to build a federalist government. If we had only built an anti-federalist government, these would all be mute issues.

    • There is much to fear when political hooligans rule on self will run rampant! Thomas Jefferson warned us to always question our government, and he helped to set it up! We’ve all sat back and let politicians create the mess where in and foolishly beleve their BS at election time. No more, their true colrs are showing loud and clear. It’s actually worse than we thought “Quite simply, the Udall amendment will remove the wording of section 1032 which clearly states that it does not apply to U.S. citizens, and in it’s place substitute language which calls for the head of the Department of Homeland Security, Hillary Clinton, Leon Pannetta, and Eric Holder to get together and craft legislation, on their own, to submit back to congress which effectively does the same thing that section 1032 does, but seemingly may or may not actually apply to U.S. citizens.
    That’s right… Udall’s proposal suggests letting globalist Hillary Clinton and her puppets rewrite something akin to the John Yoo torture memos. As written, section 1031 specifically states that it does NOT extend the powers of the executive branch under current interpretations of the war powers act whereas Mr. Udall’s proposed amendment clearly DOES provide for that end result.”

  • Wow, that was an extremely inaccurate article. Thank you PeedroPaula for finding the the applicability for US Citizens and legal aliens.

    Furthermore, if what the article said was true, hypothetically of course, it would only work once, before the victim was awarded millions from the US Gov’t and the law nullified. The laws enacted by congress cannot remove rights granted in the Constitution. Any judge in the US would rule that under the 6th Amendment, all US citizens have the right to due process and a fair trial. Also, one could argue that this would be a violation of the 8th amendment as well.

    There are only two ways to amend/change the constitution, and each requires approval from 75% of the states. There’s no way a bill like the one you inaccurately described in the post would survive, even if it was passed by congress.

  • Thanks for pointing that out and providing the source. It’s nice to have someone who knows what they’re doing post something factual and informative rather than just coming in and screaming stereotypical insults like they’re reading from a shopping list.

    That being said, it still seems like putting this in would make Alabama, Utah, and Arizona’s immigration laws Federal Policy. That cannot happen.

  • All this section says is that citizens (and in some cases lawful resident aliens) detained under this act are not required to be held in military custody . . . It definitely DOES NOT protect US Citizens (or anyone else for that matter) from being arrested under this law.

  • Except the bill doesn’t actually say that. See Section 1031 – Page 362


    (1) UNITED STATES CITIZENS.—The requirement to detain a person in military custody under this section does not extend to citizens of the United States.

    (2) LAWFUL RESIDENT ALIENS.—The requirement to detain a person in military custody under this section does not extend to a lawful resident alien of the United States on the basis of conduct taking place within the United States, except to the
    extent permitted by the Constitution of the United States.”

    • This doesn’t make it much better. This still means the military can take anyone off the street and they disappear. Any innocent person visiting this country, on a visa, a green card can disappear into some American gulag anywhere in the world.
      And if you think a citizen or two or three or more won’t also simply be caught up in this then people are kidding themselves. There’s no reason for this. It’s incredibly dangerous.

      I respect that you took time to look up the Appropriations Bill but it is the original and the concern is regarding a proposed amendment written by Senators McCain and Levin.

      I wish authors, speaking to Steven D Foster, would footnote their work as you did.

      • The wording for the original proposed bill was vague enough that a few people could interpret it to mean that. There is already amendments to the proposal that clarify that no U.S. citizen would be held without trial.

        Honestly, you cannot expect a bill to be passed that blatantly undermines one of our Bill of Rights. Just poor wording that will be fixed.

        • Absolutely correct. Besides, who needs to further overstretch our military when domestic police are already provided their weapons, armor, training, and technologies. Militarize the domestic police, and you don’t need to use the military!

          Besides, how are they going to bash Iran and Syria if they’re going to waste military man power on OWS?
