The National Defense Authorization Act Is Even Scarier Than We Thought, Allows Military To Torture American Citizens

This week, the United States Senate passed S. 1867 also known as the National Defense Authorization Act including sections 1031 and 1032 which authorize the military to arrest and indefinitely detain American citizens without trial or charge. Despite national outcry over the bill which effectively suspends the Constitutional rights of those suspected of terrorist activities and would allow Americans to be incarcerated in Guantanamo Bay prison in Cuba, the Senate passed the bill by an overwhelming margin of 93-7. This means that Congress could easily override the President’s threatened veto.

But this act of Congress is even more dangerous than we first thought. Included in the bill is Amendment 1068 which was offered by Republican Senator Kelly Ayotte of New Hampshire. This part of the bill undermines President Obama’s executive order that bans torture and overrides the list of permissible interrogation techniques in the US Army Field Manual. In other words, the US military could arrest ordinary American citizens without reading them their Miranda Rights, put them in a cell at Gitmo without the benefit of an attorney, a trial, or charges of any kind, and then torture them during interrogation. A secret list of torture techniques would be created without public knowledge.

Who does this affect? Every single man, woman, and child on American soil would be directly affected by this bill. It would give this President and all future Presidents, the power to arrest American citizens with the military and torture them into confession even if they are innocent. Essentially, it turns the Presidency into a dictatorship authorized to use the military against the people.

The Occupy movement in particular could face this unconstitutional military action. Just imagine if Republicans captured the White House in 2012. Conservative media, corporations, and Republican politicians have referred to the Occupy protesters as terrorists or worse than terrorists. Just this accusation alone gives the President cause to unleash the military to round up and arrest the protesters en masse, suspend their constitutional rights, and torture them in a prison off American soil, all because they were exercising their right to protest. This is an extraordinarily dangerous and un-American bill that would destroy the Constitution and our system of government. The judicial system would be powerless to do anything about it too.

We the people must demand that our government discard this bill permanently. It goes against everything America values and stands for. We must write, email, call, and protest our senators and representatives and the White House and call for action. You can also visit this page and sign a petition. Unless Americans stand up and fight this, we may one day have to rely on other countries to free us from ourselves.

  • this is outrage in the military its not about detaining innocent people its about protecting them and their rights thats what its been about this whole time so if we go through with this bill were taking away what we have fought for. so why pass a law that is bound to result in dictatorship as a soon to be marine corps troop i feel that this is wrong and hope that there are other marines that are on my side with this i am ok and proud to protect america but if it involves actually taking americans from foriegn countries who went through so much to be a legal citizen and torturing them for looking a certain way i dont know what this world is coming to its wrong unlawful unjust and cruel all i can do about this is wait and do my duties as a marine in the military!!!!!!!!!!!!!

    How stupid are you Hopkins,this was passed by the senate, the democrates are the majority in the senate. Did you ever think about that before making your statement. So if this senate bill passed by 93 in favor and 7 nays votes, it means both democrates and repbulicans passed the bill. Are you this miss informed or uneducationed that you can not draw this simple conclusion from the senate vote. Or is this an emotional reaction from you. Personally I do not agree with the passing of the bill by the senate and we should be aware that our elected senators passed the bill, be vigilent.

  • bill ‘o rights is correct. 100 Senators voted on this UN-constitutional bill…out of that number 93 voted FOR the bill AND committed TREASON against the American people while ONLY 7, SEVEN honored their oath to uphold the constitution of the United States, voting against the bill!     • He wasn’t “forced” to testify against himself, he was told that the President isn’t immune for civil lawsuits for actions occurring before he was President. Very different concept there. He could always have not testified during the court proceedings but he chose to give a deposition. Once the truth came out and you could see the lying and covering up he did we could all then see why he was trying to hid behind the Presidency. The second President ever impeached, quite a legacy he left! LOLOL

  • Am I not reading the correct bill? The Thomas website has the following as the passed bill: where section 1032 contains the following:

    (b) Applicability to United States Citizens and Lawful Resident Aliens-
    (1) UNITED STATES CITIZENS- The requirement to detain a person in military custody under this section does not extend to citizens of the United States.
    (2) LAWFUL RESIDENT ALIENS- The requirement to detain a person in military custody under this section does not extend to a lawful resident alien of the United States on the basis of conduct taking place within the United States, except to the extent permitted by the Constitution of the United States.

  • I’ve been posting about this on my facebook page since Thursday and have contacted both my Senators and expressed my outrage. The Patriot Act was just the opening in the door that the horde needed to push its way in. This bill makes me ashamed to be an American. How can anyone who believes in any form of human rights, vote to support this bill ( even the need to add another $662 billion dollars makes no sense ). We need to vote out every incumbent senator and replace them with any non-Republican/Democrat. Both parties are too corrupt to continue.

  • I’m not disagreeing with you about the problems here, but you SHOULD verify that the President is doing what you are saying he is doing because it doesn’t help this country to spread unfounded fears about specific actions being taken like this.     Go back and read the statements made by Obama and his administration. They are threatening veto, because they don’t feel that the bill, in its present state, grants the executive branch enough power to follow through on its provisions, carte blanche!

    I personally don’t understand what is really going on in Washington right now, but it most definately crosses party lines. What I DO know is that in June Mr. Obama moved the military’s entire Northern Command to U.S. soil and 20,000 troops are training alongside civilian police. Some have said they are performing civilian detainment exercises, crazy as that sounds. I cannot verify this, however.

    Moreover, Russian military analysts are speculating that the U.S. government is preemptively taking steps to contain civil chaos in the event that the nation falls into economic collapse, which they are anticipating.

    All of this sounds like madness, I agree. After all, I don’t believe in alien abductions or Kennedy assassination conspiracies. On the other hand, did any of us believe, until yesterday, that a bill like this could pass through both houses?

        You can find out who voted for what, how many votes they’ve taken part in, even how many days of session they missed. You need to know this, so you continue to support those who represent you, or get them out in favor of those who represent you better.

      Why did so many vote for it? Because this is the essential DoD re-authorization act that essentially says “this is what the military can do, and this is how much money we’re going to give them to operate this year”. Without this bill, the Armed Services would effectively stop at the end of this fiscal year.

      The vast majority on Congress doesn’t even know the individual provisions placed in the bill. They just know that the military will cease function without it. That’s why there was so much unquestioning support.
