Supreme Court Won’t Take A Second Look At Janet Jackson’s Breast

One day after making news on health care, the Supreme Court quietly took a stand for the nation’s mental health, refusing to consider the FCC’s appeal to reinstate an indecency fine it levied against CBS for the 2004 Super Bowl halftime show in which Janet Jackson’s breast was briefly glimpsed, causing  a horrified nation to shut its eyes until play resumed and it was safe to watch violence again.

The FCC originally fined CBS $555,000 for the ‘Wardrobe Malfunction,’ a term that Chief Justice Roberts said, “strained credulity.” The fine has twice been overturned in appeals courts, and this was thought to be the FCC’s last hope of having it re-instated.
